This paper explores the evolution of online sports gambling policies and the gaps in the current state-by-state regulatory scheme, in addition to discussing the necessary components of a viable national solution.

This Article provides an expert-level analysis of the emergent market for regulated sports wagering—examining the evolution of sports wagering before legalization, the Murphy decision, and the market for sports wagering since Murphy. The Article then proceeds to elucidate some of the high-profile failures of the present market for sports wagering and examines ways of ameliorating many of these failures.

This Note will explore the post-PASPA landscape of sports gambling. In particular, it will address the tension between sports gambling laws passed by individual states and the desire for new federal legislation to replace the now-extinct PASPA. This Note recommends that the ideal course of action is federal legislation to set a minimum baseline that all state laws must at least meet.

This Article (or, perhaps more accurately stated, short treatise) is the first of its kind to provide a detailed analysis of how the United States regulates sports gambling in the aftermath of Murphy v. NCAA. Part I of this Article provides an abbreviated history of sports gambling around
the world and explains the earliest forms of gambling activity in the United States.

This Note will argue that state laws that continue to completely prohibit gambling on college sports will force consumers to seek alternatives in the illegal gambling market, thus neutralizing attempts to protect the integrity of college sports. It will also argue that state laws allowing college sports gambling without restrictions enhance risks to the integrity of college sports. Ultimately, this Note will argue that the “middle-ground” approach already taken by multiple states, which permits gambling on college sports with some important limitations, is correct. It will urge other states that have not legalized sports gambling to adopt this approach while also providing a legislative roadmap for doing so.

This explosion in sports betting also raises legal issues in the business legal community. First and foremost, the decision has created collegiate athletes as an easy target in the new industry.

Gambling is an inherently risky activity. New technologies have led to the development of new, online forms of gambling such as sports betting, with round the clock availability and accessibility. While young men have been identified as a group that may be particularly vulnerable to the harms associated with these new online products, few studies have qualitatively explored young men’s perceptions of the risks associated with these products. Using concepts associated with the sociology of risk, this paper sought to explore the range of factors that may influence how 18–24 year old young Australian men conceptualise the risks associated with sports betting.
